Privity of Contract/Illegality and Public Policy Preview


This contract law tutorial / lecture session reviews various principles in contract law including third party rights, i.e., privity of contract, capacity of the contracting parties; circumstances which make a contract illegal and the public policy considerations which operate. Primary principles explored include contracts illegal as formed and illegal as performed; contracts in restraint of trade; contracts with minors; Contract (Rights of Third Parties) Act 1999; and devices to circumvent the harshness of the privity of contract rule.
